A kivételes jogrend és a demokrácia
A kivételes hatalomgyakorlás hosszú ideje a viták középpontjában áll, hiszen a lényegét tekintve a megoldás a normalitástól való elszakadás és a politikai vezető(k), különösen a végrehajtó hatalom szinte korlátlan hatalommal való felruházása. A kivételes hatalomgyakorlás legnagyobb dilemmája az, hogy miként őrizhető meg a kivételes eszközökkel védendő status quo (azaz a fennálló „normalitás”) a végrehajtó hatalom rendkívüli aktivizálásának segítségével. Mindez különösen a hatalommegosztáson alapuló alkotmányosság és a liberális demokráciák tekintetében vet fel igen jelentős problémákat, ugyanis azok egyik legfontosabb működési szabálya, a hatalommegosztás elve kerül „kikapcsolásra” időlegesen a kivételes esemény elhárításának/elhárulásának idejére. Természetesen a hatalommegosztást és a jogállamiságot tekintve idővel helyreáll a rend és pusztán időbeli késéssel érvényesül a hatalmi ágak elválasztása, ennek ellenére a kivételesség mindig a végrehajtó hatalom előtérbe kerülését, továbbá a törvényhozás és a bírói kontroll gyengülését eredményezi. Mindezek alapján joggal merül fel az a dilemma, hogy a szükséghelyzetek kezelésére szolgáló kivételes állapot eredendően antidemokratikus-e vagy pedig éppen a demokrácia normál állapotban való fenntartásának eszköze. Ebben a tanulmányban a Covid–19 kapcsán vizsgálom meg a kivételes állapot és a demokrácia összetett és ellentmondásos kapcsolatát. A teljesebb képhez azonban utalni kell arra is, hogy mivel a kivételes állapot által hordozott antidemokratikus veszélyforrások elsősorban a felhatalmazással rendelkező kormányzatokhoz kötődnek és ezek a jelenségek fokozottan meghatározták a második világháború utáni politikaelméleti tendenciákat, a végrehajtó hatalomnak komoly szerepe lehet az autokráciák kialakulásában. Éppen ezért jelen tanulmányban az elméleti kiindulópontok tisztázása után először történeti kontextusban tárgyalom a végrehajtó hatalomban rejlő autoriter tendenciákat, amelyek a XX. század eszmeés politikatörténetében az alkotmányos diktatúra problematikájával kapcsolatban jelentkeztek, manapság pedig a kormányzati filozófiák átalakulásában, egyfajta állandó válságmenedzseri kormányzati filozófiában öltenek testet. Ezután térek rá arra, hogy a közelmúlt egymásra torlódó válságai közül a globálisan talán legmeghatározóbb Covid–19- pandémia kapcsán áttekintsem és elemezzem azokat a szakirodalmakat, amelyek a kivételes jogrend és kormányzás demokráciaproblémáival foglalkoznak. A többszempontú (történeti és kortárs megközelítéseket egyaránt vizsgáló) elemzés fő kérdése tehát, hogy a rendkívüli eszközökkel való kormányzás miként és hogyan hat a demokráciára, melyek azok az eszközök és módszerek, amelyek segítségével gátat szabhatunk a végrehajtó hatalom autoriter jellegének a vészhelyzeti időszakban.
Abstract
The exercise of exceptional power has long been at the centre of debates, as the solution is essentially to break away from normality and give political leader(s), especially the executive, almost unlimited power. One of the major dilemmas of exceptional power is therefore how to preserve the status quo, i.e., the existing “normality”, which must be protected by exceptional measures, through the extraordinary activation of the executive. This raises very significant problems, particularly in periods of constitutionalism and liberal democracies based on the check and balances, when the principle of separation of powers is temporarily “switched off” for the time needed to avert an exceptional event. However, it can be argued that, in terms of the separation of powers and the rule of law, order is restored over time and the separation of powers is enforced only with a time lag, but using exceptional measures always results in the predominance of executive power and a weakening of legislative and judicial control. The dilemma arises as to whether exceptional governance is inherently anti-democratic or whether it is a means of maintaining democracy in a normal state. In this paper I examine the complex and contradictory relationship between state of exception and democracy in the context of COVID-19. However, for a fuller picture, it is also necessary to suggest that, since the anti-democratic threats posed by the state of exception are primarily associated with empowered governments and have increasingly shaped post-World War II political theory trends, the executive may have a major role in the emergence of autocracies. Therefore, in the present paper, after clarifying the theoretical starting points, I will first discuss in a historical context the authoritarian tendencies inherent in executive power, which emerged in the history of ideas and politics in the 20th century in relation to the problem of constitutional dictatorship and today take shape in the transformation of philosophies of government, in a kind of permanent crisis-managerial philosophy of government. Furthermore, in the context of the COVID-19 pandemic, perhaps the most globally significant of the recent successive crises, I review and present the literature that addresses the democratic problems of exceptional governance. The main question of this multi-pronged analysis, exploring both historical and contemporary approaches, is thus how and in what ways exceptional governance affects democracy, and what are the tools and methods that can be used to check the authoritarian nature of the executive in state of exception.
